For example, a herniated disc treated with surgery has a $100,000 to $350,000+ range. If the Dasher was waiting for an offer in Texas, DoorDash says the Dasher's own auto insurance is primary. A Texas policy at the state minimum pays at most $30,000 for one injured person. If the Dasher had accepted the order, DoorDash says its liability insurance also applies, up to $1,000,000 in most states. DoorDash lists a $250,000 combined limit for an active delivery in Kentucky.
A pedestrian, cyclist, or motorcyclist hit by a Dasher still needs the Dasher's app activity at the time of the crash.

Does DoorDash insurance cover accidents?
DoorDash says its liability insurance pays for injuries and property damage an at-fault Dasher causes during an active delivery. The delivery starts when the Dasher accepts the order and ends when the order is marked delivered, unassigned, or canceled. DoorDash calls that span the "Delivery Service" Period; its Boston section calls it "Active Status."
| Dasher activity | DoorDash insurance | Dasher's own policy |
|---|---|---|
App off | DoorDash lists no coverage maintained by DoorDash. | DoorDash says the personal policy applies for personal use. |
Logged on and waiting for an offer. DoorDash calls this the "Delivery Available" Period in four state sections. | DoorDash lists its own waiting-period coverage in North Dakota, Indiana, Kentucky, and West Virginia. DoorDash lists none in its Boston section. | DoorDash says the Dasher's auto insurance is primary in all other U.S. states while the Dasher waits. |
On an active delivery, from accepting the order until it is marked delivered, unassigned, or canceled | DoorDash says its third-party liability insurance applies when the Dasher is at fault, up to $1,000,000 in most states. DoorDash lists $250,000 combined in Kentucky. | DoorDash requires a primary auto policy. It says a delivery-eligible personal policy can apply first, subject to policy terms and local law. |
A combined limit is one amount for injury and property damage together. DoorDash's Help Center gives no dollar amount in its "All Other US States" section; the $1,000,000 figure comes from Dasher Central. DoorDash requires Dashers to carry primary auto insurance at the local minimum. Its Dasher Central FAQ says a business-use or delivery-eligible personal policy can apply before DoorDash's liability insurance, subject to policy terms and local law.
Report the claim to the Dasher's insurer and DoorDash. The Texas Department of Insurance says most personal policies do not cover accidents while delivering items for a fee. The North Carolina Department of Insurance says North Carolina personal auto policies do not cover a vehicle used to deliver goods for a delivery platform. DoorDash's U.S. liability description does not require a personal insurer's denial letter first. DoorDash puts that condition in its section for Canada, Australia, and New Zealand.
DoorDash lists State Farm Insurance Company, Mobilitas Insurance Company, Crum & Forster, and Helmsman Management Services as insurance partners, depending on the state and claim. DoorDash says Blue Star Claims handles occupational accident claims.
For Boston electric and motorized bicycles during "Active Status," DoorDash lists $50,000 for bodily injury to one person, $100,000 for bodily injury to everyone in the accident, and $30,000 for property damage, effective January 2, 2026. DoorDash lists a $1,000,000 combined limit for Boston automobiles during active delivery.

Which states have DoorDash insurance while Dashers wait?
DoorDash lists coverage for a logged-on Dasher waiting for an offer in North Dakota, Indiana, Kentucky, and West Virginia. DoorDash says an incident before a state's effective date does not receive that state's listed coverage. The Dasher must be liable for the injury or damage.
| State and effective date | DoorDash coverage while waiting | DoorDash liability on an active delivery |
|---|---|---|
North Dakota, August 1, 2023 | $50,000 bodily injury per person; $100,000 per accident; $25,000 property damage; $50,000 uninsured motorist; $50,000 underinsured motorist; personal injury protection under the North Dakota Auto Accident Reparations Act. | $1,000,000 combined. |
Indiana, July 1, 2024 | $50,000 bodily injury per person; $100,000 per accident; $50,000 property damage. | $1,000,000 combined. |

What do state delivery insurance laws require?
North Dakota, Kentucky, and West Virginia require primary liability insurance during both the waiting period and active delivery. The laws of North Dakota, Kentucky, and West Virginia require at least $50,000 for one injured person, $100,000 for everyone injured in an accident, and $25,000 for property damage. Kentucky also requires the greater amount if its cited motor vehicle law sets a higher minimum.
| State | Delivery company law |
|---|---|
North Dakota | The 2023 delivery network company law also requires uninsured motorist, underinsured motorist, and personal injury protection coverage. |
Kentucky | Kentucky's delivery network company insurance rules took effect January 1, 2025. |
West Virginia | Its Delivery Network Company Insurance Act took effect July 1, 2025. Its personal vehicle definition includes motorcycles and mopeds. |
In North Dakota, Kentucky, and West Virginia, the driver, company, or both can carry the required insurance. If the driver's policy lapses or lacks the required coverage, the company's insurance covers the claim from the first dollar and defends it. Those three laws do not make company coverage depend on a personal insurer denying the claim first. They allow personal insurers to exclude coverage for both periods, and they require written notice to drivers that their own policy might not cover the work.
Tennessee's delivery network company insurance requirements take effect January 1, 2027. The governor signed House Bill 2175 as Public Chapter 1011 on May 26, 2026.
Florida and Texas write their transportation network company insurance rules for passenger rides. Texas defines delivery companies separately. The passenger-ride insurance amounts in those two states do not set the amount for a DoorDash delivery.

What insurance applies to a DoorDash delivery in California?
California's Proposition 22 requires a delivery network company to maintain at least $1,000,000 per occurrence in liability insurance for people injured by a driver in a car during an accepted delivery, when the car is not otherwise covered by a policy meeting the law's cited Insurance Code rule. The law calls the time from accepting a request through completing it "engaged time."
For a California Dasher hurt while online, Proposition 22 requires occupational accident insurance for medical expenses up to at least $1,000,000 and lost income payments of 66% of average weekly earnings from all network companies, subject to the law's weekly minimum and maximum, for up to the first 104 weeks after the injury. The law also requires accidental death insurance for a spouse, children, or other dependents. DoorDash points California Dashers to a separate benefits schedule.

How do you prove a DoorDash driver was on a delivery?
Ask the Dasher whether an order was active at the moment of the crash, then ask DoorDash in writing to keep the app records for that time. DoorDash's U.S. Dasher privacy policy, updated July 1, 2026, says its app uses location information to track a task, including when an order was picked up and delivered. The policy gives no fixed record-keeping period.
DoorDash's insurance incident form says it does not provide Dasher activity to third parties without legal or law enforcement requests. A subpoena in a federal lawsuit can require a company to produce electronic records it holds under Federal Rule of Civil Procedure 45. Ask for the driver's answer at the scene and keep the crash report; the police report guide explains how to get one.
Kentucky law requires the company or insurer to give claimants and other named parties the precise start and end times of delivery periods for the 24 hours before and 24 hours after a crash, immediately upon request. North Dakota and West Virginia require those times for the 12 hours before and 12 hours after a crash upon request by directly involved parties or an insurer. In those three states, when the period is disputed and the company lacks or fails to give the times, its insurer takes primary liability for the claim. Each state also requires the driver or company, as its law specifies, to disclose whether the driver was waiting or on a delivery when the named people ask.
A driver can be logged on to several apps at once. The app with the active order decides which company's coverage applies. DoorDash says its delivery period starts with an order accepted on its own platform. Ask which app held the order. If the driver was carrying an Uber passenger, see the Uber accident guide.

How do you report a DoorDash accident?
DoorDash tells people involved in a U.S. crash to use its Insurance-Related Incident Submission Form. The form asks for incident details, Dasher details, third-party details, non-vehicle property damage, and involved parties. DoorDash asks for one form per incident and up to 3 business days for a response. DoorDash support is available 24/7 at 855-431-0459.
For an emergency, DoorDash says to call 911. DoorDash tells Dashers to photograph the vehicles, plates, and surroundings, exchange contact and insurance details, notify their own insurer as their policy requires, and use the Dasher app safety tools. If an insurer calls you, the recorded statement guide explains that conversation.

Can you sue DoorDash for a car accident?
A claim against DoorDash for its own conduct is different from a claim for a Dasher's careless driving. DoorDash calls Dashers independent contractors. During an active delivery, DoorDash says its liability insurance covers injuries an at-fault Dasher causes up to the policy limit.
West Virginia law treats a delivery driver as an independent contractor unless a written agreement says otherwise. Texas law treats a delivery person as an independent contractor if its listed conditions, including a written agreement, are met. The Court of Appeals of Indiana described Indiana law as preventing a claim that DoorDash is responsible for a Dasher's driving simply because the Dasher uses DoorDash, unless a written contract says otherwise.
In Oller v. DoorDash, Inc., a car crash case decided September 18, 2026, the Court of Appeals of Indiana held that DoorDash owed a duty to protect against risks from its business model and app, which the court said financially incentivize distracted or otherwise dangerous driving. The court was deciding an early motion from the pleadings, accepted the complaint's allegations as true for that decision, and sent the case back. It did not decide that the injured person won money, and its ruling addressed one Indiana case. The complaint alleged that the Dasher left the scene to finish a delivery; the hit-and-run guide addresses a driver leaving a crash.

What if another driver hit you while you were dashing?
The other driver's liability insurance pays for injuries and damage that driver caused. The Texas Department of Insurance describes liability insurance as paying other people's medical expenses and damaged property when its insured driver is at fault. The injury ranges above apply to a Dasher's claim against that driver.
| Claim | Who pays and what is covered |
|---|---|
The other driver caused the crash | That driver's liability insurer pays for the injuries and property damage the driver caused, up to its policy limit. |
The Dasher was hurt during an active DoorDash delivery | DoorDash says its occupational accident coverage pays medical expenses up to $1,000,000 and disability payments of 50% of average weekly wages up to $500 per week minus other income. It also lists survivor's benefits without an amount. |
The Dasher's own car or bike was damaged | DoorDash says its insurance does not repair the Dasher's car, and its occupational accident coverage does not cover car or bike damage. Address the vehicle damage with the auto insurer. |
DoorDash says occupational accident coverage has applied automatically to U.S. Dashers since June 27, 2019, with no enrollment, premium, deductible, or copay. It applies while making a DoorDash delivery. DoorDash's occupational accident FAQ says Blue Star Claims takes online claims at www.bluestarclaims.com and phone claims at (480) 579-2405, available 24/7/365. California Dashers have the separate Proposition 22 schedule described above.
DoorDash lists uninsured and underinsured motorist coverage for waiting Dashers in North Dakota, and uninsured motorist coverage for waiting Dashers in West Virginia. For other claims, read the Dasher's own policy; the underinsured motorist claim guide covers what to do when the other driver's insurance is too small.

Is the New York City DoorDash settlement about accidents?
The $131.5 million New York City DoorDash settlement announced September 22, 2026 is about delivery worker pay, not crashes or injuries. DoorDash says $12.3 million is for Dashers who were underpaid or paid late, over $83 million resolves a disagreement over pay for time between deliveries, and $16.7 million goes to the city's Department of Consumer and Worker Protection in fines. The pay settlement does not decide an accident claim.

How do fault and filing deadlines affect a DoorDash claim?
Your state's fault rules affect how responsibility for the crash changes your claim; see comparative negligence by state. The deadline to file a lawsuit, called the statute of limitations, also depends on the state; find it in the state filing deadline guide.
What should you do after a DoorDash accident?
Ask about the order, save the crash evidence, and report the incident to DoorDash and the Dasher's insurer. Keep the answers with your treatment records.
Ask which app had the order
Ask the driver whether a DoorDash order was active when the crash happened. Ask whether the driver had accepted it or was still waiting for an offer.
Save the scene and the driver details
Photograph the vehicles, license plates, and surrounding area. Get the driver’s name, phone number, and insurance information. Ask the police for the crash report.
Ask DoorDash to preserve the app records
Send DoorDash a written request to keep the Dasher’s app records for the time of the crash. DoorDash says its app records location and delivery progress, but it does not give Dasher activity to a third party without a legal or law enforcement request.
File DoorDash’s insurance incident form
Send one Insurance-Related Incident Submission Form to DoorDash with the crash details, Dasher details, your contact information, the names of other involved parties, and any non-vehicle property damage. DoorDash asks for up to 3 business days to respond.
Report the claim to the Dasher’s insurer
Give the Dasher’s auto insurer the crash details and ask for its coverage position. Save the insurer’s response and the records of your treatment and losses.
Find your state’s filing deadline
Look up your state’s personal injury statute of limitations, which is the deadline to file a lawsuit. Write down the date that applies to your claim.

Kentucky, North Dakota, and West Virginia also require delivery companies to provide period times after a crash to the people those laws name.
