After a crash with a Grubhub driver, ask for the driver's vehicle insurance and find out whether a delivery was active. If you were delivering for Grubhub and someone else caused the crash, your claim starts with that driver's insurer. This page covers crash claims; the Grubhub class-action and refund settlements concern other disputes.

How much is a Grubhub accident settlement?

Grubhub accident settlements range from $5,000 to $5,000,000+ by injury, with treatment and fault affecting the range. Grubhub's driver agreement requires the driver to carry vehicle insurance covering delivery work.

As of October 29, 2026, Grubhub's driver help center lists its own third-party auto insurance for one state, North Dakota. California law requires a delivery company to keep at least $1,000,000 per occurrence during an accepted delivery in a car, when the car has no other policy that meets California's insurance rule.

Grubhub says it generally requires a valid subpoena to process private requests for records. Ask for the driver's app records and written confirmation of the insurance that applies to your crash.

For a Grubhub crash, the driver's own vehicle policy and the state decide which insurance is available and how much it pays. The policy limit sets the most money payable under that insurance policy.

Example: A broken bone requiring surgery has an injury range of $100,000 to $350,000+. Texas requires car liability insurance of at least $30,000 for one injured person, $60,000 for all injured people in a crash, and $25,000 for property damage, effective January 1, 2011. The Texas Department of Insurance lists paid food deliveries among the activities most personal policies exclude. Ask whether the Grubhub driver's policy covers delivery work before treating its amount as insurance available for the claim.

Who pays when a Grubhub driver hits you?

The Grubhub driver's own vehicle insurance is the first place to look for payment. Grubhub's driver agreement, updated October 22, 2026, requires the driver to pay for vehicle insurance covering every vehicle used for delivery, all delivery activities, and state and local minimums. The agreement calls the driver a "Delivery Partner" and requires proof of coverage on request.

Grubhub warns in that agreement that a personal auto policy "may not afford" liability, comprehensive, collision, medical payments, personal injury protection, uninsured motorist, underinsured motorist, or other coverage during Grubhub deliveries. Grubhub's sign-up page, updated October 28, 2026, requires car drivers to have auto insurance.

Insurance or requirementWhen it appliesWhat the document says

The agreement sets its vehicle insurance duty for motor vehicles and sets no insurance duty for bicycle deliveries.

What insurance does Grubhub's help center list?

As of October 29, 2026, Grubhub's driver help center lists its own third-party auto insurance for one state, North Dakota. Grubhub warns on its page for that state that the driver's automobile policy "might not provide any coverage" while the driver is available for orders or on an active delivery.

Ask Grubhub in writing whether any company insurance applies to your crash, whatever state you are in.

Personal policies and property damage

The Texas Department of Insurance says most personal policies exclude crashes during paid food or goods deliveries. The North Carolina Department of Insurance says personal auto policies in North Carolina exclude the driver and vehicle while delivering goods through a delivery platform, and names Grubhub among those platforms.

Grubhub's driver terms, effective June 30, 2025, address a payment for property the driver damages: if Grubhub reimburses the third party for reasonable repair costs, the driver agrees to repay Grubhub. The term describes repayment between Grubhub and the driver; it makes no promise that Grubhub will pay your repair bill.

What if the Grubhub driver used a bicycle or motorcycle?

Grubhub's agreement requires vehicle insurance for motor vehicle deliveries and sets no insurance duty for bicycle deliveries. Grubhub says cars and motorcycles are supported in all its delivery areas, while bicycle deliveries are supported in certain areas, such as San Francisco.

The agreement names cars, motorcycles, and scooters as motor vehicles. West Virginia's delivery insurance law includes motorcycles and mopeds in its vehicle definition. See the motorcycle injury guide or the e-scooter accident guide for those injuries.

Grubhub's sign-up requirements ask bicycle drivers for identification without listing an insurance requirement. For injuries while cycling or walking, read the bicycle accident guide or the pedestrian accident guide.

How do you get Grubhub’s records after an accident?

For private information requests, Grubhub says it "generally requires a valid subpoena" before it will process the request. Grubhub's records guidelines require personal service through its registered agent and ask for at least 14 calendar days from service to respond. Send Grubhub a written request soon after the crash to keep the driver's location and delivery records for that time.

What the app records contain

Grubhub's driver privacy policy, effective January 9, 2026, says it may collect precise device location while the app runs on screen or in the background. Grubhub lists dates and times for accepted, rejected, canceled, and completed orders, plus delivery duration, routes, and payment for each order. The driver agreement also says Grubhub may track and share location while the driver is logged in and available for offers.

Grubhub says it keeps location information while the driver has an account and for an additional period it decides is necessary for legal obligations and defending claims. Grubhub says it may share personal information with insurance providers and their agents and consultants for insurance and risk purposes. The privacy policy also says insurers may give Grubhub information during an incident investigation.

How to request copies

Grubhub's private-request guidelines direct you to your state's Secretary of State website to find its current registered agent. Grubhub rejects subpoenas sent by email or to a Grubhub office. The request needs a narrow time period, specific records, and enough information to identify the driver or account, ideally more than a name. Grubhub says it does not respond to emergency requests from people outside law enforcement.

A subpoena in a federal lawsuit can require Grubhub to produce specified documents or electronic records that Grubhub possesses, holds, or controls, under Federal Rule of Civil Procedure 45. State courts use their own rules.

State rights to the app times

Kentucky, West Virginia, and North Dakota require the delivery company or its insurer to provide the precise beginning and ending times of waiting and delivery periods immediately on request. In Kentucky, directly interested parties, claimants, their counsel, and insurers are entitled to the times for the 24 hours before and the 24 hours after the crash. West Virginia and North Dakota require the times for the 12 hours before and the 12 hours after the crash when a directly involved party or any insurer requests them.

In these three states, the company's insurer must assume primary liability for a claim if the company lacks, did not keep, or fails to provide those times and the parties dispute a period's beginning or end. In West Virginia and North Dakota, the driver must disclose whether the driver was waiting or delivering when an interested party, auto insurer, or investigating police officer requests it. Kentucky requires that disclosure from the driver or company and includes claimants and their counsel among the people entitled to ask.

In these three states, request these times under the state delivery law. For private requests elsewhere, follow Grubhub's subpoena guidelines. Ask whether the app was off, available for orders, or on an active delivery: Grubhub's listed insurance and the state insurance requirements depend on those periods.

Which app had the accepted order?

Grubhub's agreement allows work for a competing business during a Grubhub delivery, but Grubhub says its occupational accident insurance excludes deliveries for another company. Occupational accident insurance covers a worker's own injuries on the job; Grubhub buys this insurance for its drivers. Ask which app had the order at the crash time; for a different order, use the DoorDash accident guide or Uber Eats accident guide. The insurance California requires for drivers' own injuries and deaths does not have to cover time online without an accepted order when the driver is completing an accepted order for another company.

What is the Grubhub accident claims phone number?

Grubhub lists 1-866-280-4394 for its drivers' occupational accident injury claims with Zurich. A person hit by a Grubhub driver should file with the driver's insurer and their own insurer, report the crash to police, and ask Grubhub in writing to keep the app records.

Phone numberPurposeWho handles the report
1-866-280-4394
A Grubhub driver's own occupational accident injury claim.
Zurich, the insurer. Grubhub says these claims go directly to the insurance provider.

Call 911 first if someone is injured or immediate safety is threatened, as Grubhub's emergency page directs. Photograph the vehicles, plates, crash area, and visible delivery bag or order. Collect the driver's name, contact details, insurance card, and witness names. Ask whether the app was on and whether the driver had an accepted Grubhub order.

Ask police for a copy of the report using the crash report guide. If the driver leaves, see the guide for a hit-and-run claim. Before responding to an insurer's request for a recorded interview, read the recorded insurance statement guide.

Which states require delivery insurance for Grubhub drivers?

Kentucky, West Virginia, and North Dakota make delivery companies ensure primary auto liability insurance during two periods: waiting online for requests, and driving to collect an order through delivery. The statutes call these the delivery available period and delivery service period.

State and law dateMinimum insurance for both periodsTimes the company must provide
Kentucky: effective January 1, 2025.
Kentucky requires $50,000 per person and $100,000 per accident for bodily injury, and $25,000 for property damage, or the amount in KRS 304.39-110(1)(a)1. if greater.
Immediately on request, the waiting and delivery start and end times within 24 hours on either side of the crash.
West Virginia: effective July 1, 2025.
West Virginia requires property damage liability of $25,000 and bodily injury liability of $50,000 per person and $100,000 per accident.
Immediately on request, the waiting and delivery start and end times within 12 hours on either side of the crash.
North Dakota: 2023 law, filed April 12, 2023.
North Dakota requires bodily injury liability of $50,000 per person and $100,000 per accident, and $25,000 for property damage. It also requires uninsured motorist, underinsured motorist, and personal injury protection coverage.
Immediately on request, the waiting and delivery start and end times within 12 hours on either side of the crash.

These three states allow the driver, delivery company, or both to supply this insurance. In these three states, if the driver's policy has lapsed or lacks the required coverage, the company's insurance must cover the claim from the first dollar and defend it, without requiring another auto insurer to deny the claim first.

During both periods, personal auto insurers in these three states are allowed to exclude coverage and any duty to defend the claim or pay on the driver's behalf.

Passenger rideshare laws

Florida and Texas define rideshare companies through passenger trips, so their passenger rideshare insurance amounts do not apply to food deliveries. Texas separately defines delivery companies as businesses arranging deliveries of food, beverages, or consumer goods; its chapter on those companies sets no delivery insurance amount.

What insurance does California require for Grubhub deliveries?

California law requires delivery companies to keep at least $1,000,000 in auto liability insurance per occurrence for harm caused to other people during an accepted delivery in a car, when that car is not otherwise covered by a policy satisfying Insurance Code section 11580.1(b). This is California's requirement, rather than an amount listed in a Grubhub policy document.

California voters approved Proposition 22 on November 3, 2020. The law counts engaged time from the driver's acceptance of an order through its completion.

California also requires occupational accident insurance for drivers' medical expenses and lost income from injuries while online. California's medical requirement is "up to at least one million dollars ($1,000,000)". For up to the first 104 weeks after injury, California requires disability payments equal to 66% of the driver's average weekly earnings from all network companies at the injury date. The weekly amount must stay within the minimum and maximum set by the Labor Code. California also requires insurance benefiting the driver's spouse, children, or other dependents after an accidental death.

Grubhub's California help articles describe its no-cost occupational accident insurance for medical expenses and lost income from injuries while making deliveries, underwritten by Zurich American Insurance Company as policy OCA 0553716-00. The medical and disability figures above are California's legal minimums. As of October 29, 2026, Grubhub's help center does not state that policy's benefit amounts.

What can an injured Grubhub driver claim?

A Grubhub driver injured by another driver seeks injury compensation and car repairs from that driver's liability insurer. The Texas Department of Insurance explains that an at-fault driver's liability coverage pays for the other people's medical expenses, car repairs or replacement, and other damaged property. The injury table above also applies to this claim.

Grubhub says it buys occupational accident insurance for its drivers. Grubhub describes benefits for medical expenses and lost income from injuries while making deliveries.

Grubhub says its occupational accident insurance covers injury expenses and lost income, not vehicle damage.

Grubhub says all drivers have been eligible since January 1, 2024, subject to policy terms, conditions, limitations, and exclusions, and no enrollment is needed. Its coverage page describes the period as "from the time you accept a delivery offer to the time the order is delivered or the offer is canceled". A driver waiting for an offer is outside that period.

Grubhub says claims go directly to Zurich's online claim site or the driver injury claim line listed above, and a third-party adjuster will handle the claim. Grubhub's help center, as of October 29, 2026, gives no medical maximum, weekly benefit amount, or death benefit amount for the general occupational accident policy. Grubhub says the actual policy controls if it conflicts with the help articles.

Grubhub's agreement says drivers are not eligible for workers' compensation through Grubhub and are responsible for their own workers' compensation insurance. The agreement says occupational accident insurance "may be maintained in lieu of workers' compensation insurance to the extent permitted by law".

If the other driver has no insurance or too little, look at your own uninsured and underinsured motorist coverage. The underinsured motorist claim guide explains seeking compensation through your own policy.

Can you sue Grubhub?

You can name Grubhub in an injury lawsuit, and the court decides whether Grubhub must pay. Filing a lawsuit is a separate step from an insurance claim. Grubhub's driver agreement calls the relationship one of independent contracting, not employment. Grubhub's customer terms, effective December 17, 2024, deny that drivers are its agents or employees and deny responsibility for their delivery services. Those customer terms do not bind a stranger hit by a driver, and Grubhub's statements are not a court decision on your claim.

The driver agreement names Grubhub Holdings Inc., a Delaware corporation. Grubhub's records guidelines also describe drivers as independent third parties. In West Virginia, delivery drivers are independent contractors by law unless the parties agree otherwise in writing. Texas treats a delivery driver as an independent contractor when both sides agree to that status in writing and the company neither sets the driver's hours or territory nor bars other apps or other work. The Texas rule took effect September 1, 2025.

Wonder Group, Inc. bought Grubhub from Just Eat Takeaway.com. Grubhub announced the deal on November 13, 2024, and the seller announced its completion on January 7, 2025. The seller said Wonder acquired all Grubhub assets and assumed all material liabilities associated with Grubhub.

Start looking for insurance with the driver's policy and ask whether any Grubhub insurance applies. Use the state requirements above where they apply, and request the app records needed to identify the delivery period.

Are the Grubhub settlements in the news about accidents?

The Grubhub business-practices settlement and California driver pay settlement do not resolve crash injuries. Neither settlement decides your accident claim.

The Illinois Attorney General announced a $25 million settlement with Grubhub on December 17, 2024, with $24.8 million in restitution for harmed consumers nationwide, over alleged deceptive practices rather than crashes. The allegations concerned delivery prices, subscription benefits, advertised driver earnings, and restaurant listings without consent. In its August 13, 2026 announcement about those non-crash claims, the Illinois Attorney General said the Federal Trade Commission was sending more than $23.8 million to drivers and consumers nationwide and sending payments to 640,038 affected consumers.

The United States District Court for the Northern District of California approved the $24,750,000 settlement in Lawson v. Grubhub Holdings Inc. on July 30, 2026, resolving California driver pay and classification claims, not crash injuries. The court's class definition covers California independent-contractor deliveries from December 3, 2014, through March 13, 2026. The settlement divides money by miles driven.

How long do you have to file after a Grubhub accident?

The state sets your filing deadline and the rules for dividing fault. Find the statute of limitations, meaning the deadline to file a lawsuit, in the state personal injury deadline guide. Use the state comparative negligence guide to read how your share of fault affects compensation.

What should you do after a Grubhub accident?

Get emergency help when needed, save the crash and delivery details, and report the insurance claims. Ask Grubhub to preserve the app records while you seek copies.

1

Call for help and photograph the crash

Call 911 for injuries or an immediate threat to safety, following Grubhub’s emergency instructions. Photograph the vehicles, license plates, surroundings, and any visible delivery bag or order. Get the driver’s name, phone number, insurance information, and witness names.

2

Ask which app had the order

Ask whether the Grubhub app was off, available for orders, or on an active delivery when the crash happened. Find out which company had the accepted order. Request the driver’s insurance card.

3

Ask Grubhub in writing to keep the app records

Write to Grubhub soon after the crash and ask it to keep the app records. Identify the driver and crash time, and specify the location and order records you want kept. To seek copies, use a subpoena served through Grubhub’s registered agent or request delivery period times under the state law in Kentucky, West Virginia, or North Dakota.

4

File the insurance claims and get the police report

Report the crash to the police and request the crash report. File claims with the Grubhub driver’s insurer and your own insurer. Ask in writing whether any Grubhub insurance applies to the crash.

5

Find your state’s lawsuit deadline

Use the state filing deadline guide to find the time limit for your claim. Keep the crash date and your claim records together when reviewing that deadline.

Grubhub accident settlement questions

How much is a Grubhub accident settlement worth?

The injury ranges for a Grubhub crash run from $5,000 to $5,000,000+. Treatment and the division of fault affect the value. A Grubhub driver injured by someone else uses the same injury ranges for the claim against that driver.

Who pays when a Grubhub driver hits your car?

The Grubhub driver’s own vehicle insurance is the first place to look for payment. Grubhub’s agreement requires the driver to buy insurance that covers delivery work. Ask in writing whether Grubhub insurance also applies, and identify the state and the driver’s app activity.

Does Grubhub insurance cover accidents?

As of October 29, 2026, Grubhub’s driver help center lists Grubhub’s own third-party auto insurance for one state, North Dakota. The driver’s own vehicle insurance is the first place to look for payment. Grubhub’s North Dakota page lists bodily injury insurance up to $50,000 per person and $100,000 total. Grubhub also describes occupational accident insurance for its drivers’ own injuries.

Does Grubhub require insurance for bicycle deliveries?

Grubhub’s agreement sets no insurance duty for bicycle deliveries; it requires vehicle insurance for motor vehicle deliveries. Grubhub’s sign-up requirements ask bicycle drivers for identification and car drivers for auto insurance.

How do you get Grubhub’s records after a crash?

Grubhub says it generally requires a valid subpoena for private information requests. Grubhub’s guidelines require personal service through its registered agent and at least 14 calendar days to respond. Kentucky, West Virginia, and North Dakota also give claimants a state-law route to request delivery period times.

What if a Grubhub driver uses several delivery apps?

Grubhub’s agreement permits drivers to work for competing businesses at the same time. Grubhub says its occupational accident insurance excludes deliveries for another company. Ask which app had the order when the crash occurred.

What is the Grubhub accident claims phone number?

Grubhub lists 1-866-280-4394 for its drivers to submit their own occupational accident injury claims to Zurich. That number is the driver injury insurance line. If a Grubhub driver hit you, file with the driver’s insurer and your own insurer, report the crash to police, and ask Grubhub to keep the delivery records.

How do you open a claim with Grubhub?

If a Grubhub driver hit you, open claims with the driver’s insurer and your own insurer, report the crash to police, and ask Grubhub in writing to keep the app records. Grubhub drivers submit their own occupational accident injury claims directly to Zurich online or at 1-866-280-4394, not through Grubhub.

What happens if you are injured while delivering for Grubhub?

If another driver caused your injuries, seek compensation from that driver’s liability insurer. Grubhub also describes occupational accident insurance for its drivers’ medical expenses and lost income during accepted deliveries. Grubhub says that insurance does not pay for the driver’s car.

When does Grubhub occupational accident insurance apply?

Grubhub says its occupational accident insurance begins when you accept a delivery offer and ends when the order is delivered or the offer is canceled. Waiting for an offer is outside that period. Grubhub says eligible drivers need no enrollment and pay nothing for the coverage, subject to the policy terms, conditions, limitations, and exclusions.

Does this guide cover a Seamless delivery driver accident?

A Seamless order is treated as a Grubhub order in this guide because Seamless’s terms identify Grubhub Holdings Inc. and its related companies as the operators.

How much are people getting from the Grubhub settlement?

The Grubhub settlements in the news concern business practices and California driver pay, not crash injuries. The Illinois Attorney General’s August 13, 2026 announcement about non-crash claims says the Federal Trade Commission is sending more than $23.8 million to drivers and consumers nationwide and payments to 640,038 affected consumers. The separate California driver pay settlement totals $24,750,000, according to the federal court’s July 30, 2026 approval order. Neither settlement sets compensation for a crash.

How long do you have to file a Grubhub accident claim?

Filing deadlines for Grubhub injury lawsuits differ by state. Find the deadline that fits your claim in the state personal injury deadline guide.

Can you sue Grubhub after a driver causes a crash?

Yes, you can name Grubhub in a lawsuit for your injuries. A lawsuit is separate from an insurance claim; the court decides whether Grubhub must pay. Grubhub’s agreement describes drivers as independent contractors, and its customer terms deny responsibility for delivery services. Those are Grubhub’s contract statements; they do not decide a stranger’s injury claim.
